Terms of Service

You must be at least 18 years old, or the age of majority in your state, to create an account. By creating an account you represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

Contend NIL is a self-reported NIL (Name, Image, Likeness) valuation tool. You enter your own stats and social following, and we generate an estimated score and dollar range using a published formula (see Methodology). Contend NIL also hosts a public feed, rankings, and a marketplace listing NIL opportunities — some posted directly by brands on the platform ("native" listings), and some aggregated from public sources elsewhere on the web ("externally-sourced" listings, marked "Found Elsewhere").

Contend NIL is not an agent, advisor, broker, or NIL collective. We do not negotiate, guarantee, facilitate payment for, or verify any deal — native or externally-sourced. Scores and valuations are estimates for informational purposes only, not a guarantee of actual earnings or an offer of compensation. Externally-sourced listings are not brokered through Contend NIL; you deal directly with the third party at your own risk, and should independently verify any opportunity before pursuing it.

You're responsible for keeping your login credentials confidential and for all activity under your account. Every profile and post is tied to a real, individual account — impersonating another person, creating an account on someone else's behalf without authorization, or maintaining more than one account for yourself is not allowed.

You own the stats, posts, and other content you submit. By posting to the public feed, leaderboard, or your profile, you grant Contend NIL a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content on the service (including in generated share cards and media kits) for as long as your content remains public. You're solely responsible for what you post, and you represent that you have the right to post it.

Content defaults to private. It only becomes public if you explicitly opt in (e.g. checking "list me on the public leaderboard," or publishing a feed post). You can delete your own posts at any time.

Don't use Contend NIL to harass, impersonate, defraud, or post false or misleading information (including fabricated stats or follower counts), scrape or bulk-collect data from the service, or attempt to circumvent account, security, or rate limits. We can remove content or suspend or terminate accounts that violate these Terms, with or without notice.

Externally-sourced marketplace listings link out to third-party websites and offers we don't control and haven't vetted beyond confirming they were publicly posted somewhere. We're not responsible for the content, accuracy, or outcome of any third-party posting, application, or deal.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT SCORES, VALUATIONS, OR MARKETPLACE LISTINGS ARE ACCURATE, COMPLETE, OR WILL RESULT IN ANY ACTUAL NIL OPPORTUNITY OR EARNINGS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTEND NIL, LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE OR ANY THIRD-PARTY LISTING OR OPPORTUNITY FOUND THROUGH IT.

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use Contend NIL after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles.
